HYLUK operates hyluk.com and all related content, features, tools, products, and services in order to provide you—the customer—with a premium shopping experience (the “Services”). Our store is powered by Shopify.

The terms and conditions below, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use our Services.

HYLUK reserves the right to accept or decline any order at its discretion, subject to applicable law. Your order is not accepted until we confirm the order.

Payment must be received and successfully processed before an order is confirmed and fulfilled.

Please review your order carefully before submitting it. Once an order has been accepted or submitted for fulfillment, we may be unable to accommodate cancellation requests.

If we cannot accept, modify, or must cancel an order, we will notify you using the email address provided at the time of purchase and, where applicable, issue a refund for amounts paid for the cancelled portion of the order.

All purchases are subject to our refund policy.

You confirm that purchases made through our services are for personal or household use and not for unauthorized commercial resale or export.

SECTION 5 — SHIPPING AND DELIVERY

Delivery timeframes are estimates only and are not guaranteed unless expressly stated otherwise.

HYLUK is not responsible for delays caused by shipping carriers, customs processing, weather events, governmental actions, incorrect or incomplete shipping information, or other circumstances outside our reasonable control.

Once an order has been dispatched and transferred to the carrier, shipping and delivery are subject to the carrier's terms and applicable law.

  • USA & Canada: 8–9 business days

  • United Kingdom: 9 business days

  • Europe: 11 business days

  • Rest of World: 12–20 business days

These estimates may vary depending on destination, carrier conditions, customs processing, holidays, and other circumstances.

Customers are responsible for providing accurate shipping information. HYLUK is not responsible for delivery problems caused by an incorrect or incomplete address supplied by the customer.

SECTION 6 — INTELLECTUAL PROPERTY

All content on hyluk.com—including, but not limited to, trademarks, brand identity, text, images, graphics, product photography, videos, audio, logos, designs, product names, and other materials—is owned by HYLUK LLC or its licensors and is protected by applicable intellectual property laws.

Unless expressly authorized by HYLUK in writing, you may not reproduce, distribute, modify, publicly display, republish, download, store, transmit, sell, license, or otherwise exploit material from our Services.

HYLUK's online store is powered by Shopify, which provides the e-commerce platform that enables us to sell our products and services.

However, purchases made through our store are transactions between you and HYLUK LLC.

Shopify is not the seller of HYLUK products and is not responsible for the products sold by HYLUK, except to the extent required by applicable law.

TO THE FULLEST EXTENT PERMITTED BY LAW, HYLUK DISCLAIMS IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM USE OF OUR SERVICES OR PRODUCTS WILL MEET YOUR PARTICULAR EXPECTATIONS.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HYLUK LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HYLUK'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT PURCHASED FROM HYLUK SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO HYLUK FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

THE LIMITATIONS ABOVE DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

SECTION 18 — INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless HYLUK LLC, its members, managers, officers, employees, affiliates, agents, contractors, and service providers from claims, losses, damages, liabilities, costs, and reasonable expenses arising out of or relating to:

  1. Your breach of these terms.

  2. Your violation of applicable law.

  3. Your violation of any third-party rights.

  4. Your misuse of our services.

  5. Your unauthorized use of HYLUK intellectual property.

  6. Content or feedback submitted by you that violates these Terms or third-party rights.

This indemnification obligation does not apply to the extent that a claim results from HYLUK's own conduct for which indemnification is prohibited by applicable law.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law.

If the provision cannot be enforced, it shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

SECTION 20 — WAIVER & ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies expressly incorporated into these Terms, constitute the entire agreement between you and HYLUK LLC concerning your use of our Services and supersede prior or contemporaneous agreements concerning the same subject matter, except where otherwise required by applicable law.

SECTION 21 — ASSIGNMENT

You may not transfer or assign these Terms or any of your rights or obligations under these Terms without our prior written consent, except where permitted by applicable law.

HYLUK LLC may assign or transfer these Terms, including in connection with a merger, acquisition, restructuring, sale of assets, or other business transaction, subject to applicable law.

SECTION 22 — GOVERNING LAW

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to conflict-of-law principles that would require application of another jurisdiction's laws.

To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any transaction between you and HYLUK shall be brought in the state or federal courts located in New Mexico, and you consent to the jurisdiction and venue of those courts.

Nothing in this section prevents a consumer from exercising rights or bringing a claim in a jurisdiction where applicable consumer-protection law grants that consumer the right to do so.

We reserve the right to update or replace any part of these Terms at any time.
